4. Terms of Service

These Terms of Service ("Terms") are an agreement between you and the business Igloo Studios ("Igloo Studios," "we," "us," "our"). They govern your use of our online store and every purchase you make from it. By using the store or placing an order, you agree to these Terms, our Return and Refund Policy, Limited Warranty, Shipping Policy, and Privacy Policy, which are part of these Terms. If you do not agree, please do not use the store.

4.1 Your statutory rights

Nothing in these Terms excludes, limits, or waives any right or remedy you have under consumer protection law that cannot legally be excluded, including the consumer protection laws of Ontario, your province or territory of residence, or your state of residence. If any part of these Terms conflicts with such a law, the law prevails and the rest of these Terms continues to apply.

4.2 Eligibility

You must be at least the age of majority in your province, territory, or state to place an order. If you are under that age, you may use the store only with the involvement and consent of a parent or guardian.

4.3 Our products: lab-created moissanite

All gemstones sold by Igloo Studios are laboratory-created moissanite. Moissanite is a distinct gemstone made of silicon carbide. We do not sell diamonds, and no product is represented as a natural, mined, or lab-grown diamond. Where we describe brilliance, fire, or hardness, we are describing the general properties of moissanite.

Product photos are for illustration. Colour and brilliance may look slightly different depending on your screen and lighting. Stated lengths, widths, and weights are approximate and may vary slightly because pieces are finished by hand.

4.4 Metal composition

Option A (solid sterling silver): Unless a product page states otherwise, our metal settings and chains are made of solid sterling silver containing at least 92.5% pure silver (925 sterling). Some pieces may have a rhodium finish for added shine and tarnish resistance. Rhodium finishes can wear over time with normal use; this is not a defect.

Option B (plated): Unless a product page states otherwise, some of our metal settings and chains are made of a brass base finished with a silver-tone rhodium plating. These items are not solid sterling silver. Plating naturally wears over time with normal use, and we make no guarantee of how long any plating will last.

4.5 Pricing and availability

Prices are shown in the currency displayed at checkout and may change without notice; the price that applies is the one shown when you place your order. Products are subject to availability, and we may limit quantities or discontinue products at any time. If an item you ordered becomes unavailable, we will notify you and refund you for that item.

4.6 Pricing and listing errors

If a product is listed at an obviously incorrect price or with an incorrect description because of a typographical, technical, or system error, we may cancel the order before it ships. If we do, we will notify you and give you a full refund, or offer you the item at the correct price if you prefer.

4.7 Orders and acceptance

Your order is an offer to buy. You will have the chance to review your order, correct errors, and accept or decline before you pay. We send an order confirmation email after purchase, which serves as your copy of this agreement. We may decline or cancel an order before it ships, for example because of suspected fraud, an unverifiable payment, a pricing error, or unavailability. If we cancel, you receive a full refund.

4.8 Payment

Payments are processed securely by our third-party payment providers through Shopify. We do not store your full card number. By paying, you confirm you are authorized to use the payment method.

4.9 Shipping, returns, and warranty

Delivery, returns, refunds, exchanges, and warranty coverage are governed by our Shipping Policy, Return and Refund Policy, and Limited Warranty. Title and risk of loss pass to you when the order is delivered to the address you provided.

4.10 Reviews and content you submit

You are free to post honest reviews of our products anywhere. If you submit reviews, photos, or other content to our store or tag us on social media, you give us a non-exclusive, royalty-free licence to display that content in connection with our store and marketing, crediting you where practical. You confirm the content is yours and does not violate anyone's rights. We may remove content that is unlawful, abusive, or spam. We will not remove or alter a review simply because it is negative.

4.11 Intellectual property

The Igloo Studios name, logo, product photography, designs, and site content belong to Igloo Studios, or our licensors. You may not copy, reproduce, or use them for commercial purposes without our written permission.

4.12 Prohibited use

You agree not to: break any law while using the store; use a payment method you are not authorized to use; interfere with the store's security or operation; scrape or copy the store's content in bulk; or resell our products while representing yourself as affiliated with us.

4.13 Third-party services and links

Our store relies on third parties such as Shopify, payment processors, and shipping carriers, and may link to social media. We are not responsible for their content or practices, which are governed by their own terms.

4.14 Disclaimer

Except for the Limited Warranty and any warranty or condition that cannot be excluded by law, the store and its content are provided "as is." We do our best to keep the store accurate and available, but we do not promise it will always be error-free or uninterrupted.

4.15 Limitation of liability

To the maximum extent permitted by applicable law, Igloo Studios is not liable for indirect, incidental, special, or consequential damages arising from your use of the store or products, and our total liability for any claim relating to a product is limited to the amount you paid for that product. These limitations do not apply to the extent they are prohibited by the consumer protection law that applies to you, and they do not limit liability for our own negligence causing personal injury, fraud, or willful misconduct.

4.16 Resolving problems

If you have a problem, please email support.igloo.studios@gmail.com first. Most issues are resolved quickly this way. If we cannot resolve it within 30 days, either of us may pursue the matter in a court of competent jurisdiction, including small claims court. We do not require arbitration, and nothing in these Terms prevents you from contacting a consumer protection agency, your card issuer, or pursuing any remedy available to you by law.

4.17 Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you are a consumer living in another province, territory, or a U.S. state, you also keep the protection of any mandatory consumer laws of the place where you live.

4.18 Changes to these Terms

We may update these Terms from time to time. The version posted when you place an order applies to that order. The effective date at the top shows when these Terms were last changed.

4.19 General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part is not a waiver. These Terms and the policies they reference are the entire agreement between you and us regarding your purchase.
